Using the online payment gateway indicates that you accept these terms. These terms form an agreement between you (the user) and Scott Winton Nominees Pty Ltd (Scott Winton). If you do not accept these terms, do not use the online payment gateway.
1 Payment methods
Payments placed through this website may be made online using the Westpac Banking Corporation ABN 33 007 457 141 (Westpac) payment gateway (Third-Party Payment Gateway).
1.1 Westpac payment gateway
Scott Winton uses the Third-Party Payment Gateway provided by Westpac for its online payment transactions. Payments made through Westpac are subject to Westpac’s own terms and conditions and privacy policy. For more information about Westpac, please visit https://www.westpac.com.au/.
Scott Winton does not have access to any personal information you may provide to Westpac, other than the information required in order to process your transaction such as [your name, email address and billing/postal address].
1.2 User warranties and responsibilities
The user warrants and accepts responsibility for the following:
- ensuring that they are lawfully permitted, and have obtained all necessary consents, to provide the personal details necessary to complete the payment through the Third-Party Payment Gateway;
- ensuring that the personal details provided through the Third-Party Payment Gateway are correct and up-to-date;
- verifying that there are sufficient funds to cover any payments;
- confirming that the payment has been successfully deducted from their bank account; and/or
- addressing any issues that arise with Westpac if the payment is not processed through the Third-Party Payment Gateway.
1.3 Disclaimer
The Third-Party Payment Gateway is being provided in order to facilitate users access to pay their fees online for Scott Winton’s services. Scott Winton makes no representation as to the operation of the Third-Party Payment Gateway other than for this purpose. Use of the Third-Party Payment Gateway is at the user’s own risk and responsibility.
2 Dealings with third parties
2.1 Content supplied by third parties
The Third-Party Payment Gateway may allow third parties to advertise goods and/or services for sale to users. Scott Winton takes no responsibility and assumes no liability for:
- any content that is, or may reasonably be considered to be, harmful, harassing or abusive;
- any of the information supplied by such third parties; and/or
- any loss or damage that results from any dealings that you may have with such third parties.
2.2 Third party goods and services and websites
Scott Winton does not endorse or recommend any third-party goods or services that may be listed or referred to on any third-party websites. Scott Winton is not responsible for the content on third-party websites and does not make any representations, guarantees or warranties regarding their content or accuracy.
3 Limitation of liability
To the maximum extent permitted by law, and subject to any rights you many have as a consumer under the Australian Consumer Law, Scott Winton excludes all liability to you or any other person for loss, cost, expense, claim or damage arising directly or indirectly out of, or in connection with, use of the Third-Party Payment Gateway by you or any other person.
